What is probate — and do you even need it?

Probate is the court-supervised process of settling someone’s estate: validating the will, paying debts, and transferring assets to the rightful heirs.
In Florida, most estates go through either formal administration or a simpler summary administration, depending on the estate’s size and how long ago the person passed.
Some assets pass outside probate — joint accounts, beneficiary designations, and living trusts. We’ll tell you exactly what needs to go through court and what doesn’t.
