If you've found this page, you're likely a Florida elder law attorney putting together a Personal Services Contract / Family Caregiver Agreement. Welcome, I'm happy that my site has become a resource for lawyers (insert typical, yet important, "don't rely on my site, laws are subject to change, etc..." disclaimer). I created this life expectancy chart page because I am often googling the same two life expectancy tables and for some reason, DCF and SSA don't make these charts all that prominently available. I've included links to the source material.

For those of you who are not Medicaid-planning attorneys, using these charts are essential to the creation of a valid personal services contract.

If you/your client only needs Florida Medicaid Waiver or ICP (and who are not SSI recipients), the first chart is the one propounded by DCF and can be relied upon.

But if you are dual-eligible for both Florida Medicaid and Social Security Income (SSI), and want to use a personal services contract to pay a caregiver and avoid gifting/transfer penalties, then I use the usually more conservative social-security administration life expectancy table (second table below). When in doubt, compare the two tables, and use the lower life-expectancy value.
