Florida Estate Planning & Medicaid Planning Lawyers

Elder Needs Law is a Florida-based estate planning law firm. We help our clients preserve their assets with asset protection, estate planning, and Medicaid planning. Our attorneys are skilled and experienced in estate planning and can help you make a financial plan for your next life stage.

Some of the outcomes of partnering with us might include:

  • Holding on to more investment and retirement savings for your children
  • Avoiding long-term care expenses that may drain your savings
  • Ensuring you have enough insurance to shield your assets from adverse outcomes
  • Eliminating probate expenses

It would be best if you didn’t wait too long to begin estate planning. If you do, some or all of your estate can be lost paying for nursing home care. Fortunately, you can avoid this situation with proper estate planning and Medicaid planning.

Elder Needs Law can partner with you to create an estate plan and/or Medicaid asset protection plan to preserve what you own while paying for your current living expenses.

Medicaid & Medicare Planning

Do you think Medicare will pay for long-term care expenses? Many Americans hold this belief. Unfortunately, it isn’t usually true. Medicare will only pay for the first 20 days of a nursing home stay related to rehabilitation. On day 21, you have to pay a copay. Medicare coverage of skilled nursing care usually drops to zero on day 101.

The good news is that Medicaid planning can protect your assets in a way that allows you to become eligible for Medicaid long-term care programs (such as ICP Medicaid and Medicaid Waiver). But how do you get Medicaid without reducing the size of your estate and going broke?

Elder Needs Law can guide you with Medicaid planning, so you don’t need to spend down your assets to qualify for the program. It’s also often possible to keep your family home; you don’t need to sell it to qualify.

Our lawyers are skilled in protecting client assets as much as legally possible. So even if you need to enter a long-term care facility, we may save your assets without affecting your Medicaid eligibility.

For instance, we will guide you on the 60-month look-back period the program requires when transferring assets. If you give money or property to your family other than your spouse in those five years, you can be ineligible for the program.

Our attorneys can advise you on this critical subject. They may ensure you obey the law, qualify for the program, and preserve your assets. If assets need to be transferred within five years, there are limited and very specific ways to do so.

Medicaid planning takes careful consideration. So, speaking to Elder Needs Law is essential to devise the best strategy.

Comprehensive Estate Planning

Elder Needs Law also can assist with comprehensive estate planning, including:

  • Wills
  • Trusts
  • Advance directives
  • Powers of attorney

Elder Law

Elder law refers to many legal specialties Elder Needs Law can help you with, primarily including:

Probate

Probate is the process that goes over your estate assets and distributes them as your will provides. Going through probate is expensive and takes time (and sometimes necessary).

Our attorneys will attempt to create a strategy to eliminate the need for probate.

Guardianship

Guardianship is a legal relationship created when the court appoints a representative to care for an older person who can no longer make their own decisions.

TESTIMONIALS

What People Say About Us

"Jason and his team are responsive and communicate very well. Jason helped me to get the benefits that I qualified for much faster than expected. I would recommend him highly. My case seemed complicated to me, but Jason explained everything in detail and made everything go quite smoothly. I interviewed several elderlaw attorneys prior to choosing Jason Neufeld."

"Quick turn around time for appointments, great response time, very thorough, never rushed through and soooo easy to do business with over the internet! Read the website info, very very helpful!"

“The attorney Jason and his team are amazing at planning and execution. Me and my family would not trust anyone else with our estate planning needs.”

“I've been very impressed! A friend referred me and I've experienced nothing but perfect service and professionalism. I am extremely grateful!”

“A strong recommendation for Jason Neufeld and his Elder Law firm - very professional, patient, reliable, and experienced. When my father fell terminally ill, I became responsible for his assets and finances overnight, including the daunting task to qualify him for Medicaid. I interviewed several elder law firms but was most impressed by Jason’s client approach and practices. Throughout the process, Jason and his team provided clear guidance and support to successfully complete all the new and complex tasks required as a POA, and more importantly he enabled us to quickly achieve our goals related to Medicaid and estate planning. His fees are more than reasonable for the level of due diligence and support we received.”
