What to Include in an Estate Plan

When creating an estate plan, there are several components you should include:

  • Last Will and Testament: This legal document outlines how you want your assets distributed after your passing and appoints an executor/personal representative to oversee the process. Rarely will our Florida estate planning attorneys suggest that a client rely solely on their Last Will for estate planning. Last Will and Testament are only effective when presented to a judge. In other words: probate court.
  • Trusts: Trusts offer more control and flexibility in asset distribution, privacy, and avoiding probate court. They can be beneficial for managing complex estates or providing for specific needs. However, trusts are not just for the wealthy. If you own your home and have more than one bank account or have multiple children, a revocable trust will be beneficial.
    - Sometimes we build trusts within trusts. For example, if you have two children and one is irresponsible, you might want the irresponsible child’s share of your assets held within a trust for their benefit so it is not subject to creditor claims, ex-spouses in a divorce, and so that they otherwise cannot waste funds that remain in the trust for their benefit.
  • Powers of Attorney: Designating powers of attorney grants trusted individuals the authority to make financial, contractual, and other important decisions for you if you become incapacitated.
  • Healthcare Directives: These documents, such as a living will or healthcare proxy (called a healthcare surrogate in Florida), outline your preferences for medical treatment and appoint someone to make medical decisions if you cannot.
  • Beneficiary Designations: Ensure that your assets with beneficiary designations, such as retirement accounts or life insurance policies, are up-to-date and aligned with your overall estate plan.
  • Guardianship Designations: If you have minor children, it's essential to designate a guardian who will care for them in the event of your untimely passing.
  • Digital Assets: Consider including instructions for managing digital assets, such as online accounts, social media profiles, and cryptocurrency holdings.

Remember, estate planning is highly personal, and the components included may vary based on individual circumstances and goals. Working with an experienced estate planning attorney can ensure your plan is comprehensive and tailored to your needs.

FAQ: Plantation Estate Planning

When should I start estate planning?

It is never too early to start estate planning. Regardless of age or wealth, having a plan in place is crucial. Life is unpredictable, and having an estate plan can provide peace of mind and protect your interests during unforeseen circumstances. It's advisable to review and update your plan regularly to account for changes in your personal, financial, or family situation.

However, a few good milestones that suggest meeting with an estate planning attorney would be worthwhile are: the birth of a new child, the purchase of a home, wanting to protect a special needs child, grandchild, or other family members who needs to be protected, or it's been 7-10 years since you’ve last had your estate plan reviewed.

Do I need an estate plan if I don't have significant assets?

Yes, estate planning is not only for individuals with substantial wealth. Regardless of the size of your estate, having an estate plan allows you to dictate how your assets will be distributed and who will manage your affairs in case of incapacity or death. It also helps avoid potential conflicts among family members and ensures your personal and healthcare decisions are respected.

Can I change my estate plan in the future?

Yes, you can and should update your estate plan periodically or when significant life events occur. Life changes, such as marriage, divorce, the birth of a child, or the acquisition of new assets, may necessitate revisions to your plan. Regularly reviewing your estate plan with an attorney ensures that it remains up-to-date and aligned with your current wishes and circumstances. Remember, estate planning is an ongoing process, and making adjustments as needed is important.

"Quick turn around time for appointments, great response time, very thorough, never rushed through and soooo easy to do business with over the internet! Read the website info, very very helpful!"

“The attorney Jason and his team are amazing at planning and execution. Me and my family would not trust anyone else with our estate planning needs.”

“I've been very impressed! A friend referred me and I've experienced nothing but perfect service and professionalism. I am extremely grateful!”

“A strong recommendation for Jason Neufeld and his Elder Law firm - very professional, patient, reliable, and experienced. When my father fell terminally ill, I became responsible for his assets and finances overnight, including the daunting task to qualify him for Medicaid. I interviewed several elder law firms but was most impressed by Jason’s client approach and practices. Throughout the process, Jason and his team provided clear guidance and support to successfully complete all the new and complex tasks required as a POA, and more importantly he enabled us to quickly achieve our goals related to Medicaid and estate planning. His fees are more than reasonable for the level of due diligence and support we received.”
